Efectivament, podem vendre el nostre pis malgrat estigui llogat.<\/p>\n<p>Tanmateix, \u00e9s important con\u00e8ixer els drets i obligacions del venedor, ja que estem transmetent un immoble que est\u00e0 ocupat per un tercer com a conseq\u00fc\u00e8ncia del contracte d\u2019arrendament que vam celebrar i del qual no en tenim la possessi\u00f3.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section data-particle_enable=\"false\" data-particle-mobile-disabled=\"false\" class=\"elementor-section elementor-top-section elementor-element elementor-element-dcdf725 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"dcdf725\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-5743040\" data-id=\"5743040\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-db7b559 elementor-widget elementor-widget-heading\" data-id=\"db7b559\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Regulaci\u00f3 jur\u00eddica de la venda d'un pis llogat: el contracte que estigui en vigor NO queda extingit.<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ccfddeb elementor-widget elementor-widget-text-editor\" data-id=\"ccfddeb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>La venda d&#8217;un pis llogat ve regulada per l&#8217;article 14 de la Llei d&#8217;Arrendaments Urbans (LAU), que fou redactat pel Reial Decret-llei 7\/2019 d&#8217;1 de mar\u00e7, de mesures urgents en mat\u00e8ria d&#8217;habitatge i lloguer. Aquest article estableix que\u00a0<strong>l&#8217;arrendament perdurar\u00e0 malgrat la venda<\/strong>,\u00a0transmetent-se al nou propietari tots els drets i obligacions de l&#8217;arrendador.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0d7fbfd elementor-widget elementor-widget-image\" data-id=\"0d7fbfd\" llogater?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5fd1be5 elementor-widget elementor-widget-text-editor\" data-id=\"5fd1be5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Vendre un pis amb llogater pot semblar, a priori, un proc\u00e9s complicat.<\/p>\n<p>Aqu\u00ed tens tots els passos del proc\u00e9s que haur\u00e0s de fer en la venda del teu pis llogat.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-09cd24a elementor-widget elementor-widget-heading\" data-id=\"09cd24a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Lectura del contracte d'arrendament<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2edfb6e elementor-widget elementor-widget-text-editor\" data-id=\"2edfb6e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>En concret, quant de temps resta per a la finalitzaci\u00f3 del contracte de lloguer (incloses pr\u00f2rrogues) i quina renda est\u00e0 pagant actualment el llogater.<\/p>\n<p>Aquesta \u00e9s la informaci\u00f3 que haurem de facilitar al possible comprador de l&#8217;immoble i ser\u00e0 determinant per establir el seu preu de mercat.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-df34aa9 elementor-widget elementor-widget-heading\" data-id=\"df34aa9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Notificaci\u00f3 al llogater sobre la intenci\u00f3 de vendre el pis<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-dd338d5 elementor-widget elementor-widget-text-editor\" data-id=\"dd338d5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>\u00c9s obligatori notificar a l&#8217;arrendatari de la teva intenci\u00f3 de vendre l&#8217;habitatge, independentment que tingui o no dret de tempteig i retracte.<\/strong><\/p>\n<p>La Llei d&#8217;Arrendaments Urbans (LAU) estableix que el propietari haur\u00e0 d&#8217;informar al llogater de la seva decisi\u00f3 de vendre el pis. Aquest dret li <strong>permet al llogater igualar l&#8217;oferta de compra\u00a0<\/strong>realitzada per un tercer i adquirir l&#8217;habitatge en les mateixes condicions.<\/p>\n<p>Tot i aix\u00f2,\u00a0<strong>aquest dret no \u00e9s absolut i pot ser excl\u00f2s per pacte expr\u00e9s al contracte d&#8217;arrendament.<\/strong><\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-79ebad4 elementor-widget elementor-widget-heading\" data-id=\"79ebad4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Quins elements haur\u00e0 de contenir la notificaci\u00f3 en el sup\u00f2sit que el llogater estigui en possessi\u00f3 d'exercir el dret de tempteig i el retracte?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4cb32f8 elementor-widget elementor-widget-text-editor\" data-id=\"4cb32f8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>La notificaci\u00f3 haur\u00e0 de contenir les seg\u00fcents dades:<\/p>\n<ul>\n<li><strong>Identificaci\u00f3 de les parts:\u00a0<\/strong>nom i cognoms del propietari i el llogater.<\/li>\n<li><strong>Descripci\u00f3 de l&#8217;immoble:\u00a0<\/strong>adre\u00e7a completa de l&#8217;habitatge.<\/li>\n<li><strong>Intenci\u00f3 de vendre:<\/strong> manifestaci\u00f3 clara i concisa de la intenci\u00f3 de vendre l&#8217;habitatge.<\/li>\n<li><strong>Preu de venda:\u00a0<\/strong>indicaci\u00f3 del preu al qual es pret\u00e9n vendre l&#8217;habitatge.<\/li>\n<li><strong>Data prevista per a la compravenda:\u00a0<\/strong>data estimada per a la signatura de l&#8217;escriptura p\u00fablica.<\/li>\n<\/ul>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3d004dd elementor-widget elementor-widget-heading\" data-id=\"3d004dd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">El llogater pot seguir vivient al pis despr\u00e9s de la venda del pis?<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d3a4516 elementor-widget elementor-widget-text-editor\" data-id=\"d3a4516\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>S\u00ed<\/strong>, el llogater pot seguir vivint a l&#8217;habitatge llogat despr\u00e9s de la venda.<\/p>\n<p><strong>El nou propietari haur\u00e0 de respectar les condicions del contracte d&#8217;arrendament vigent<\/strong> i no podr\u00e0 modificar-les unilateralment. El contracte d&#8217;arrendament seguir\u00e0 vigent fins la data de finalitzaci\u00f3 o fins que es produeixin alguna de les causes previstes a la LAU.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-01770e3 elementor-widget elementor-widget-image\" data-id=\"01770e3\" elementor-widget elementor-widget-text-editor\" data-id=\"eeac62a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul>\n<li><strong>El comprador haur\u00e0 de sol.licitar al venedor tota la documentaci\u00f3 relativa a la fian\u00e7a,<\/strong> incloent el justificant de dip\u00f2sit de la fian\u00e7a a l&#8217;<strong>INCASOL<\/strong><\/li>\n<li><strong>Comunicaci\u00f3 i actualitzaci\u00f3 de la titularitat a l&#8217;INCAS\u00d2L:\u00a0<\/strong>un cop formalitzada la compravenda, el nou propietari haur\u00e0 de notificar a l&#8217;INCAS\u00d2L el canvi de titularitat de la fian\u00e7a.<\/li>\n<li><strong>Devoluci\u00f3 de la fian\u00e7a:\u00a0<\/strong>al finalitzar el contracte d&#8217;arrendament, el nou propietari ser\u00e0 l&#8217;encarregat de sol.licitar la devoluc\u00f3 de la fian\u00e7a a l&#8217;INCAS\u00d2L, pr\u00e8via comprovaci\u00f3 de l&#8217;estat de l&#8217;habitatge i el compliment de les obligacions per part de llogater.<\/li>\n<\/ul>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section data-particle_enable=\"false\"
