data-start=\"51\" data-end=\"77\">18 de desembre de 2025<\/strong> la <em data-start=\"81\" data-end=\"151\">Llei d\u2019adopci\u00f3 de mesures urgents en mat\u00e8ria d\u2019habitatge i urbanisme<\/em>, una norma que introdueix <strong data-start=\"178\" data-end=\"236\">canvis rellevants en la regulaci\u00f3 del lloguer temporal<\/strong>, del <strong data-start=\"242\" data-end=\"269\">lloguer per habitacions<\/strong> i en determinades <strong data-start=\"288\" data-end=\"320\">obligacions dels propietaris<\/strong>, i que <strong data-start=\"328\" data-end=\"379\">refor\u00e7a els mecanismes de control administratiu<\/strong> sobre determinades modalitats d\u2019arrendament.<\/p>\n<p><\/p>\n<p data-start=\"426\" data-end=\"841\">Tot i que la llei <strong data-start=\"444\" data-end=\"484\">encara no ha estat publicada al DOGC<\/strong>, la seva aprovaci\u00f3 parlament\u00e0ria fa preveure una <strong data-start=\"534\" data-end=\"563\">entrada en vigor imminent<\/strong>, previsiblement en els pr\u00f2xims dies. Per aquest motiu, molts propietaris d\u2019habitatges en <strong data-start=\"653\" data-end=\"699\">lloguer temporal a Barcelona i a Catalunya<\/strong> es pregunten <strong data-start=\"713\" data-end=\"729\">qu\u00e8 canviar\u00e0<\/strong>, si <strong data-start=\"734\" data-end=\"775\">es respectaran els contractes actuals<\/strong> i si la nova regulaci\u00f3 <strong data-start=\"799\" data-end=\"840\">implicar\u00e0 una limitaci\u00f3 de les rendes<\/strong>.<\/p>\n<p><\/p>\n<p data-start=\"843\" data-end=\"1030\" data-is-last-node=\"\" data-is-only-node=\"\">En aquest article expliquem, de manera clara, <strong data-start=\"889\" data-end=\"926\">qu\u00e8 estableix el nou marc aprovat<\/strong>, <strong data-start=\"928\" data-end=\"978\">quins efectes pot tenir en el lloguer temporal<\/strong> i <strong data-start=\"981\" data-end=\"1029\">quins aspectes cal tenir en compte des d\u2019ara<\/strong>.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-668e2f7 elementor-widget elementor-widget-heading\" data-id=\"668e2f7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Qu\u00e8 \u00e9s la nova llei del lloguer temporal a Barcelona?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-db0541c elementor-widget elementor-widget-text-editor\" data-id=\"db0541c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p data-start=\"0\" data-end=\"314\">La nova llei \u00e9s una <strong data-start=\"20\" data-end=\"68\">normativa de car\u00e0cter estrictament auton\u00f2mic<\/strong>, aplicable <strong data-start=\"80\" data-end=\"119\">\u00fanicament al territori de Catalunya<\/strong>. Introdueix <strong data-start=\"132\" data-end=\"194\">modificacions rellevants en el marc jur\u00eddic de l\u2019habitatge<\/strong>, incloent-hi la reforma de la <strong data-start=\"225\" data-end=\"265\">Llei 18\/2007, del dret a l\u2019habitatge<\/strong>, aix\u00ed com ajustos en altres normes relacionades.<\/p>\n<p><\/p>\n<p data-start=\"316\" data-end=\"380\">Entre els \u00e0mbits que regula de manera m\u00e9s destacada s\u2019hi troben:<\/p>\n<ul data-start=\"382\" data-end=\"587\">\n<li data-start=\"382\" data-end=\"413\">\n<p data-start=\"384\" data-end=\"413\">El <strong data-start=\"387\" data-end=\"411\">lloguer de temporada<\/strong><\/p>\n<\/li>\n<li data-start=\"414\" data-end=\"448\">\n<p data-start=\"416\" data-end=\"448\">El <strong data-start=\"419\" data-end=\"446\">lloguer per habitacions<\/strong><\/p>\n<\/li>\n<li data-start=\"449\" data-end=\"498\">\n<p data-start=\"451\" data-end=\"498\">La <strong data-start=\"454\" data-end=\"496\">creaci\u00f3 del Registre de Grans Tenidors<\/strong><\/p>\n<\/li>\n<li data-start=\"499\" data-end=\"538\">\n<p data-start=\"501\" data-end=\"538\">El <strong data-start=\"504\" data-end=\"536\">refor\u00e7 del sistema inspector<\/strong><\/p>\n<\/li>\n<li data-start=\"539\" data-end=\"587\">\n<p data-start=\"541\" data-end=\"587\">L\u2019<strong data-start=\"543\" data-end=\"587\">ampliaci\u00f3 del dret de tempteig i retracte<\/strong><\/p>\n<\/li>\n<\/ul>\n<p><\/p>\n<p data-start=\"589\" data-end=\"778\" data-is-last-node=\"\" data-is-only-node=\"\">\u00c9s important subratllar que <strong data-start=\"617\" data-end=\"668\">aquesta regulaci\u00f3 no s\u2019aplica fora de Catalunya<\/strong>. Els contractes formalitzats en altres comunitats aut\u00f2nomes <strong data-start=\"729\" data-end=\"777\">continuen regint-se per la normativa estatal<\/strong>.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-baef315 elementor-widget elementor-widget-heading\" data-id=\"baef315\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Quan entra en vigor la nova llei del lloguer temporal a Barcelona i a Catalunya?<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3dc176d elementor-widget elementor-widget-text-editor\" data-id=\"3dc176d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p data-start=\"0\" data-end=\"171\">La llei <strong data-start=\"8\" data-end=\"46\">ja ha estat aprovada pel Parlament<\/strong>, per\u00f2 <strong data-start=\"53\" data-end=\"93\">encara no ha estat publicada al DOGC<\/strong>. Fins que no es produeixi aquesta publicaci\u00f3, <strong data-start=\"140\" data-end=\"170\">no \u00e9s formalment aplicable<\/strong>.<\/p>\n<p><\/p>\n<p data-start=\"173\" data-end=\"462\" data-is-last-node=\"\" data-is-only-node=\"\">Tanmateix, la publicaci\u00f3 s\u2019espera de manera <strong data-start=\"217\" data-end=\"229\">imminent<\/strong>, per la qual cosa els seus efectes s\u2019han de considerar <strong data-start=\"285\" data-end=\"313\">molt propers en el temps<\/strong>. Algunes mesures tindran <strong data-start=\"339\" data-end=\"386\">aplicaci\u00f3 directa des de l\u2019entrada en vigor<\/strong>, mentre que d\u2019altres quedaran <strong data-start=\"417\" data-end=\"461\">pendents de desenvolupament reglamentari<\/strong>.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3ec8022 elementor-widget elementor-widget-image\" data-id=\"3ec8022\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t<div elementor-size-default\">A qui afecta la llei del lloguer temporal a Barcelona?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f00d886 elementor-widget elementor-widget-text-editor\" data-id=\"f00d886\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p data-start=\"0\" data-end=\"200\">Un dels <strong data-start=\"8\" data-end=\"43\">eixos centrals de la nova norma<\/strong> \u00e9s la regulaci\u00f3 del <strong data-start=\"64\" data-end=\"88\">lloguer de temporada<\/strong>, amb l\u2019objectiu de <strong data-start=\"108\" data-end=\"161\">diferenciar clarament els usos temporals leg\u00edtims<\/strong> de l\u2019arrendament d\u2019habitatge habitual.<\/p>\n<p><\/p>\n<p data-start=\"202\" data-end=\"392\">La nova regulaci\u00f3 parteix d\u2019una <strong data-start=\"234\" data-end=\"278\">presumpci\u00f3 d\u2019\u00fas com a habitatge habitual<\/strong>, que nom\u00e9s pot quedar desvirtuada si <strong data-start=\"316\" data-end=\"391\">s\u2019acredita de manera clara i suficient la causa real de la temporalitat<\/strong>.<\/p>\n<p><\/p>\n<p data-start=\"394\" data-end=\"553\" data-is-last-node=\"\" data-is-only-node=\"\">La llei estableix <strong data-start=\"412\" data-end=\"464\">dues grans categories de contractes de temporada<\/strong>, amb <strong data-start=\"470\" data-end=\"499\">r\u00e8gims jur\u00eddics diferents<\/strong> i amb <strong data-start=\"506\" data-end=\"552\">majors exig\u00e8ncies de control i acreditaci\u00f3<\/strong>.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8f79417 elementor-widget elementor-widget-heading\" data-id=\"8f79417\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Quina difer\u00e8ncia estableix la nova regulaci\u00f3 entre els diferents contractes de temporada?<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-dc5e1c2 elementor-widget elementor-widget-text-editor\" data-id=\"dc5e1c2\" temporada<\/strong> que estiguin <strong data-start=\"185\" data-end=\"267\">v\u00e0lidament signats i en vigor abans de l\u2019entrada en vigor de la nova regulaci\u00f3<\/strong> continuen regint-se <strong data-start=\"288\" data-end=\"343\">per les condicions pactades fins a la seva extinci\u00f3<\/strong>, inclosa la <strong data-start=\"356\" data-end=\"374\">renda acordada<\/strong>.<\/p>\n<p><\/p>\n<p data-start=\"377\" data-end=\"627\">La nova llei <strong data-start=\"390\" data-end=\"455\">no revisa ni modifica autom\u00e0ticament els contractes existents<\/strong>, ni introdueix <strong data-start=\"471\" data-end=\"494\">efectes retroactius<\/strong>. Per tant, els propietaris poden tenir la <strong data-start=\"537\" data-end=\"595\">tranquil\u00b7litat que els contractes actuals es respecten<\/strong> d\u2019acord amb el que s\u2019ha signat.<\/p>\n<p><\/p>\n<p data-start=\"629\" data-end=\"771\">Ara b\u00e9, la norma <strong data-start=\"646\" data-end=\"680\">s\u00ed que estableix regles clares<\/strong> per a determinades situacions que es poden produir <strong data-start=\"732\" data-end=\"770\">un cop la llei ja estigui en vigor<\/strong>:<\/p>\n<h3 data-start=\"773\" data-end=\"813\">Pr\u00f2rroga d\u2019un contracte de temporada<\/h3>\n<p><\/p>\n<p data-start=\"814\" data-end=\"1030\">Quan l\u2019arrendatari sol\u00b7liciti la <strong data-start=\"847\" data-end=\"887\">pr\u00f2rroga d\u2019un contracte de temporada<\/strong>, haur\u00e0 d\u2019<strong data-start=\"897\" data-end=\"958\">acreditar novament la causa que justifica la temporalitat<\/strong> i demostrar que <strong data-start=\"975\" data-end=\"1029\">mant\u00e9 la seva resid\u00e8ncia habitual en un altre lloc<\/strong>.<\/p>\n<p><\/p>\n<p data-start=\"1032\" data-end=\"1251\">Si en el moment de sol\u00b7licitar la pr\u00f2rroga <strong data-start=\"1075\" data-end=\"1117\">no s\u2019acredita degudament aquesta causa<\/strong>, el contracte <strong data-start=\"1132\" data-end=\"1210\">passar\u00e0 autom\u00e0ticament a considerar-se un arrendament d\u2019habitatge habitual<\/strong>, amb l\u2019aplicaci\u00f3 del r\u00e8gim corresponent.<\/p>\n<h3 data-start=\"1253\" data-end=\"1311\">Signatura d\u2019un nou contracte amb el mateix arrendatari<\/h3>\n<p><\/p>\n<p data-start=\"1312\" data-end=\"1603\">Si, un cop finalitzat el contracte, se\u2019n formalitza <strong data-start=\"1364\" data-end=\"1429\">un de nou sobre el mateix habitatge amb el mateix arrendatari<\/strong>, la llei <strong data-start=\"1439\" data-end=\"1504\">presumeix que es tracta d\u2019un arrendament d\u2019habitatge habitual<\/strong>, llevat que l\u2019arrendador <strong data-start=\"1530\" data-end=\"1602\">acrediti que persisteixen les causes que justifiquen la temporalitat<\/strong>.<\/p>\n<p><\/p>\n<p data-start=\"1605\" data-end=\"1752\">Aquesta acreditaci\u00f3 s\u2019ha de fer mitjan\u00e7ant la <strong data-start=\"1651\" data-end=\"1684\">documentaci\u00f3 de l\u2019arrendatari<\/strong>, que s\u2019haur\u00e0 d\u2019<strong data-start=\"1700\" data-end=\"1751\">incorporar al contracte i dipositar a l\u2019INCAS\u00d2L<\/strong>.<\/p>\n<h3 data-start=\"1754\" data-end=\"1778\">Aclariment important<\/h3>\n<p><\/p>\n<p data-start=\"1779\" data-end=\"1834\">La difer\u00e8ncia entre tots dos sup\u00f2sits <strong data-start=\"1817\" data-end=\"1833\">no \u00e9s casual<\/strong>:<\/p>\n<ul de la renda<\/strong> es regeix pel <strong data-start=\"208\" data-end=\"253\">r\u00e8gim propi dels arrendaments d\u2019habitatge<\/strong>.<\/p>\n<p><\/p>\n<p data-start=\"256\" data-end=\"460\">Aix\u00f2 significa que, <strong data-start=\"276\" data-end=\"330\">encara que el contracte tingui una durada temporal<\/strong>, <strong data-start=\"332\" data-end=\"376\">no existeix llibertat per fixar la renda<\/strong>, sin\u00f3 que s\u2019han d\u2019aplicar les <strong data-start=\"407\" data-end=\"459\">normes estatals en mat\u00e8ria de limitaci\u00f3 de preus<\/strong>.<\/p>\n<p><\/p>\n<p data-start=\"462\" data-end=\"723\">En particular, resulta d\u2019aplicaci\u00f3 la <strong data-start=\"500\" data-end=\"540\">Llei 12\/2023, pel dret a l\u2019habitatge<\/strong>, que estableix <strong data-start=\"556\" data-end=\"577\">l\u00edmits a la renda<\/strong> en els habitatges situats en <strong data-start=\"607\" data-end=\"659\">zones declarades de mercat residencial tensionat<\/strong>, com \u00e9s el cas de <strong data-start=\"678\" data-end=\"722\">Barcelona i molts municipis de Catalunya<\/strong>.<\/p>\n<p><\/p>\n<p data-start=\"725\" data-end=\"745\">En aquests sup\u00f2sits:<\/p>\n<ul data-start=\"747\" data-end=\"1144\">\n<li data-start=\"747\" data-end=\"874\">\n<p data-start=\"749\" data-end=\"874\"><strong data-start=\"749\" data-end=\"799\">Si l\u2019arrendador t\u00e9 la condici\u00f3 de gran tenidor<\/strong>, la renda s\u2019ha d\u2019ajustar a l\u2019<strong data-start=\"829\" data-end=\"871\">\u00edndex de refer\u00e8ncia de preus aplicable<\/strong>.<\/p>\n<\/li>\n<li data-start=\"875\" data-end=\"1144\">\n<p data-start=\"877\" data-end=\"1144\"><strong data-start=\"877\" d\u2019habitatge habitual<\/strong> vigent en els \u00faltims <strong data-start=\"1025\" data-end=\"1038\">cinc anys<\/strong>, amb les actualitzacions legalment permeses, llevat dels <strong data-start=\"1096\" data-end=\"1143\">sup\u00f2sits excepcionals previstos per la llei<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<p><\/p>\n<p data-start=\"1146\" data-end=\"1373\">Per tant, en aquest tipus de <strong data-start=\"1175\" data-end=\"1202\">contractes de temporada<\/strong>, la renda queda <strong data-start=\"1219\" data-end=\"1288\">condicionada pels l\u00edmits legals establerts a la normativa estatal<\/strong>, especialment en els sup\u00f2sits de <strong data-start=\"1322\" data-end=\"1334\">pr\u00f2rroga<\/strong> o de <strong data-start=\"1340\" data-end=\"1372\">signatura d\u2019un nou contracte<\/strong>.<\/p>\n<p><\/p>\n<p data-start=\"1375\" data-end=\"1591\" data-is-last-node=\"\" data-is-only-node=\"\">L\u2019aplicaci\u00f3 concreta d\u2019aquests l\u00edmits s\u2019haur\u00e0 d\u2019<strong data-start=\"1423\" data-end=\"1448\">analitzar cas per cas<\/strong>, atenent a la <strong data-start=\"1463\" data-end=\"1490\">situaci\u00f3 de l\u2019habitatge<\/strong>, la <strong data-start=\"1495\" data-end=\"1523\">condici\u00f3 de l\u2019arrendador<\/strong> i la <strong data-start=\"1529\" data-end=\"1590\">normativa vigent en el moment de formalitzar el contracte<\/strong>.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a1a6c3d elementor-widget elementor-widget-image\" d\u2019an\u00e0legs<\/strong>, per\u00f2 parteix d\u2019una <strong data-start=\"198\" data-end=\"242\">presumpci\u00f3 d\u2019\u00fas com a habitatge habitual<\/strong>, que nom\u00e9s pot quedar
