Temporary rental law in Barcelona and Catalonia

Letting a property on a temporary basis in Catalonia requires a justified stay and compliance with the relevant housing rules. Here is what you need to check as a property owner in Barcelona.

Catalan regulations address the purpose of the agreement, evidence of its temporary nature and rent limits. The agreed duration alone does not make a tenancy temporary.

Before signing: check the reason for the temporary stay, the rent and the contract date. The actual purpose of the stay determines how the tenancy should be arranged.

Catalan regulations: the starting point

Articles 66 bis and 66 ter of Law 18/2007 regulate temporary rentals and room rentals in Catalonia. The provisions introduced by Law 11/2025 came into force on 1 January 2026.

For stays related to work, studies, medical care or similar needs, the temporary purpose must be substantiated and the housing rules on rent, deposits, guarantees and costs must be followed. Signing an eleven-month contract does not allow these obligations to be bypassed.

These Catalan requirements remain in force. When preparing each agreement, the applicable national rules under the Urban Leases Act (LAU) must also be checked, taking account of the contract’s date and characteristics.

01 · What it means

What counts as a temporary residential tenancy?

The LAU now distinguishes between habitual and temporary residential tenancies. The latter meets the accommodation needs of someone who temporarily moves away from their usual home for a justified and verifiable reason.

A work assignment, a course of study or medical treatment may justify a temporary stay. The actual circumstances must be assessed: labelling the contract “seasonal” or agreeing on eleven months is not enough to determine its legal nature.

For contracts subject to the national reform, temporary rentals fall within the LAU’s residential tenancy framework, with specific rules on duration, early termination and guarantees. It is therefore no longer accurate to describe them generally as leases for use other than housing.

02 · Documentation

What must be substantiated in the contract?

In Catalonia, Article 66 bis of Law 18/2007 requires the purpose to be documented and the supporting evidence to be lodged alongside the deposit with the relevant register.

The contract must expressly state the reason for the temporary move. The national reform places the burden of proving that reason on the landlord. Without a properly specified reason, the agreement loses its temporary status and becomes subject to the habitual residential tenancy regime from the date it was signed.

  1. The reason for the stay

Identify the specific reason for the move and how it relates to the agreed term.

  2. Supporting documents

Keep proof of enrolment, work assignment documents or other evidence appropriate to the circumstances.

  3. The usual home

Document the tenant’s usual home elsewhere and the circumstances of the move.

  4. A continuing reason

Check and substantiate the temporary reason again before extending the stay or signing another agreement.

03 · Duration

How long can a temporary tenancy last?

The duration must reflect a genuine, substantiated temporary need. Article 66 bis of the Catalan regulations does not set a general maximum of eleven or twelve months: what matters is the purpose of the stay and whether it can be demonstrated.

A practical example

An eighteen-month master’s degree in Barcelona

Someone whose usual home is in Dublin moves to Barcelona for a master’s programme lasting a year and a half. That duration may justify an eighteen-month temporary stay if the move, enrolment and course timetable are substantiated, together with the usual residence in Dublin.

The contract term must relate to that need. Having an address in Dublin is not, by itself, sufficient evidence of a temporary stay.

The national reference to twelve months should not be presented as an absolute limit either: Article 9 bis of the LAU allows this period to be exceeded where the reason for the temporary stay continues. Its application must be coordinated with Catalan regulations.

If the stay is extended or another agreement is signed with the same person, the continuing temporary reason must be substantiated again. Simply signing successive contracts is not enough: the rules governing extensions and successive agreements must be checked.

04 · Rent

Are there rent limits in Barcelona?

A temporary tenancy does not allow the rent limits applicable to housing to be bypassed. Catalan regulations already subjected temporary rentals for work, studies, medical care and similar needs to the housing rules on setting and updating rent.

Under the national reform, temporary residential contracts subject to the new framework must also comply with Articles 17.6 and 17.7 of the LAU in designated stressed housing market areas. Calculating the rent requires checking the previous rent, whether the property was let in the past five years, the owner’s status and the application of the national reference system.

It is incorrect to say that the limit always corresponds solely to the index. Several limits may apply, and the relevant limit for the case must be respected. Nor may additional charges be used to circumvent legal restrictions.

Article 17.8 also caps annual increases between successive temporary contracts for the same property at the applicable IRAV rate. This is distinct from an annual rent review during a contract, which requires an agreed clause and is subject to the legal limits in force, including any applicable extraordinary measures.

05 · Deposit and costs

Deposits, additional guarantees and agency fees

For new temporary residential contracts subject to the national residential tenancy framework, the statutory deposit is one month’s rent. Any additional guarantee may not exceed a further month’s rent. These are separate items and must be identified individually.

The reform prohibits requiring the tenant to take out rent default insurance. Property agency and contract formalisation costs may not be passed on to the tenant, whether directly, indirectly or under another name.

An additional, non-essential service may only be charged to the tenant if they have expressly requested it in writing, having been informed in advance that it is optional and of its cost. This provision cannot be used to transfer agency fees to the tenant.

06 · Early termination

Can the tenant leave early?

For temporary residential contracts subject to the new rules, the tenant may terminate after at least one month has elapsed from signing, giving at least ten days’ notice. Termination in accordance with this rule does not entitle the landlord to compensation.

07 · Repairs

Who is responsible for repairs?

The new Article 21 bis makes the landlord responsible for maintaining the temporary accommodation and for minor repairs caused by ordinary wear and tear. The tenant must report any issue as soon as possible, and the landlord must respond within five working days.

The provision allows the tenant, if no response is received within that period, to carry out necessary repairs and claim the cost or deduct it from the following month’s rent, after providing supporting evidence to the landlord. The notification, the need for the repair and its cost should be documented.

08 · Existing contracts

What happens to contracts already signed?

This requires an individual assessment. It is not accurate to state without qualification that all earlier contracts are unaffected by the new rules. Their signing date, actual purpose, any fraud and the Catalan obligations already applicable to them must be checked.

The eighth transitional provision added to the LAU preserves the previous regime for the temporary contracts it covers until their agreed expiry, without allowing an extension under that regime; a renewed temporary tenancy is subject to the new rules.

This provision must be read alongside the protection of regional legislation. In Catalonia, a contract signed before 8 October 2026 may be subject to Catalan obligations that were already in force. Its date does not validate an agreement that disguises a need for a habitual home.

09 · Room rentals

What if the property is let by the room?

Dividing a tenancy into room rentals does not allow housing rules to be avoided. The national reform includes partial rentals within either habitual or temporary residential tenancies, depending on the need they meet.

The total rent under simultaneous contracts must comply with the rule for letting the property as a whole and, in a stressed housing market area, the applicable rent limits. Catalan occupancy and habitability requirements must also be met. The index should not be presented as the sole reference for every situation.

10 · Tourist rentals

Do tourist rentals follow the same rules?

The two arrangements should not be confused. The LAU excludes tourist lets that meet the requirements of Article 5.e and are governed by their sector-specific legislation. The reform sets a maximum duration of 31 days for these lets.

Catalan regulations contain specific provisions for exclusively recreational, holiday or leisure use. This does not allow every stay to be marketed as a tourist let or remove the need for the relevant authorisations. Before marketing the property, compliance with national, regional and municipal rules must be checked.

11 · Before letting

What to check before letting your property

  1. The actual purpose: a habitual home, a substantiated temporary move or an authorised tourist activity.
  2. The date and duration: a new contract, an earlier agreement or a renewal.
  3. The rent: rental history, applicable limits and permitted charges.
  4. The documentation: the temporary reason, usual residence elsewhere, deposit and filing obligations.
  5. The terms: guarantees, fees, early termination and repairs.
How the October national reform fits in

Royal Decree-law 29/2026 amends the national LAU and has generally been in force since 8 October. Its twelfth additional provision preserves the application of regional rules on temporary rentals and room rentals. It does not replace Catalan regulations; their rules must be coordinated with the national provisions applicable to each contract.

As at 15 October 2026, it is awaiting ratification by the Permanent Deputation. It already applies: if ratified, it will remain in force without an election or change of government automatically repealing it, subject to the specific time limits of temporary measures.
