The steps to sell an apartment in Barcelona begin before you publish the listing. First, review the property's legal position, gather the documents and calculate your net proceeds. Then organise the marketing and agree terms with the buyer. Finally, prepare for completion and take care of your remaining responsibilities as the seller.

Preparing the sale

Before listing your apartment

The aim is to go to market at a realistic price, knowing what you need to complete the sale.

Check who is selling and the property's legal position

Review the title deed and a recent Land Registry extract (nota simple): the owners, property description and registered charges should be clear. If there are several owners, a usufruct, a tenancy or protected housing restrictions, establish how these affect the transaction. For an inherited property, start by establishing and formalising the sellers' inheritance rights.

Gather the documents and identify anything missing

Check expiry dates and request what you need in good time. Some documents, such as the homeowners' association certificate and the mortgage balance statement, will need to be up to date for completion.

DocumentWhy you need it
DNI or NIE, title deed and Land Registry extractIdentify the sellers and check ownership and registered charges.
Energy performance certificateProvide the certification and energy information required to advertise and sell, subject to legal exemptions.
Occupancy certificate (cédula de habitabilidad)Check that it is valid and arrange renewal where necessary.
Homeowners' association certificate and meeting minutesCheck outstanding debts and approved costs not yet due, including any special assessments.
Building inspection (ITE) and fitness certificateReview the building inspection documentation applicable to the property.
Property tax (IBI) and utility billsCheck payments, references and contracts for completion and changes of account holder.
Asbestos certificateArrange to provide it to the buyer for sales from 3 October 2026.

The list depends on the property. Find more detail in our guide to asbestos certificates in Catalonia.

If there is a mortgage, plan how it will be discharged

Ask the bank how much is outstanding and what early repayment costs may apply. Also check the charge at the Land Registry: it may still be registered even if the loan has been repaid. This allows you to coordinate repayment and removal of the registered charge with the sale.

Calculate your net proceeds and set the asking price

Before deciding how much room you have to negotiate, estimate taxes, agency fees, certificates and any other costs payable by you. Spanish personal income tax (IRPF), or non-resident income tax, and municipal plusvalía tax are separate taxes. Our guide to municipal plusvalía tax in Barcelona explains one of these calculations.

What you will receive

Sale price − outstanding debt − taxes − costs.

The valuation should consider the location, size, condition, floor, lift and legal position. Compare similar properties and distinguish asking prices from the prices at which sales actually complete.

Before moving to the next stage: documents reviewed, issues identified and an asking price supported by an estimate of costs.

Marketing and agreeing terms

From listing to agreement with the buyer

The aim is to find a buyer and clarify the terms before committing to the sale.

Prepare the listing and organise viewings

Use photographs that clearly show the rooms, accurate information and a floor plan where possible. Keep the price and details consistent across channels. For viewings, have the community fees, IBI costs, planned building works and handover arrangements ready to discuss.

Assess the whole offer

Alongside the price, review the buyer's financing, timing and any conditions. A higher offer is not always a better fit if it requires an impossible completion date or leaves essential matters unresolved.

Record the terms in the deposit agreement

The deposit agreement (contrato de arras) should cover the price, deposit, deadline for signing the deed, charges, financing and handover. Clarify what happens if either party breaches the agreement or the expected financing is unavailable. The deposit amount and its consequences depend on the agreement and applicable law; there is no single mandatory percentage.

Where Catalan civil law applies, withdrawal deposits (arras penitenciales) must be expressly agreed. Have the contract reviewed for your transaction before signing or accepting a deposit.

Coordinate completion with the notary

Send the documents in advance. Confirm who will sign, any powers of attorney required, the balance of the price, payment methods and how the mortgage will be dealt with. Update the relevant documents and agree the handover date and allocation of costs.

Before moving to the next stage: terms recorded, financing and payments coordinated, documents ready and a workable completion date.

Signing and finishing the paperwork

Completion and final paperwork

The aim is to formalise the agreement and ensure your responsibilities as the seller are completed.

Review the deed, payment and handover

Check that the deed reflects the agreed property, price, deposits, charges and conditions. Ask for any clause you do not understand to be explained. Coordinate receipt of payment and, where necessary, repayment of the mortgage. Hand over the keys on the agreed date and keep a record of the handover.

Arrange utilities and notify the homeowners' association

Record water, electricity and gas meter readings and provide the information needed to change account holders. Confirm the changes and check the final bills. Avoid cancelling a utility contract without agreeing it with the buyer. Also notify the homeowners' association administrator of the sale.

File the taxes that apply to you

The municipal plusvalía filing deadline is generally 30 working days after the transfer. If there has been no increase in value, check how to declare and demonstrate this. Confirm who is handling the tax: the notary's notification does not, by itself, replace your declaration or self-assessment.

Keep the documents needed to declare the gain or loss in your IRPF return when due. If you are not resident in Spain for tax purposes, follow the specific non-resident rules and deadlines, including any withholding that may affect the amount you receive.

Check outstanding formalities and keep your records

The buyer or their administrative agent usually arranges registration of the purchase. As the seller, check that removal of the mortgage charge from the Land Registry is completed if you have taken responsibility for it. Keep the deed, proof of payment, invoices and tax documents.

To bring the transaction to a close: payment and handover documented, changes notified, tax obligations addressed and responsibility for any remaining formalities assigned and checked.

Three questions before you start

How long do the formalities take?

It depends on the available documents, registered charges, financing and agreed terms. Reviewing the position at the outset helps you set a realistic date for signing the deed.

Can I sell if I still have a mortgage?

Yes. The sale can be coordinated with repayment of the debt and removal of the charge. Establish the balance, costs and who will handle each step beforehand.

Who gathers the documents?

The owner provides their documents and receipts. The agency can coordinate the process, while certificates are issued by the relevant professionals, institutions or authorities. Clarify from the outset what the service you have engaged includes.
