Selling an inherited apartment in Barcelona: steps, taxes and timelines

With or without a will: what to prepare before you sell.

Selling an inherited apartment in Barcelona involves establishing who is entitled to inherit, formally accepting the inheritance and allocating the assets, and preparing the tax paperwork and property documents. You can arrange a valuation while the inheritance is being processed, but clarify the conditions of the transaction before signing a deposit agreement or committing to a completion date.

01 · Where to begin

Where do you start, with or without a will?

Request the death certificate and the Spanish certificate of last wills (certificado de últimas voluntades). You can apply for the latter once 15 working days have passed since the death. It states whether a will is registered and which notary holds it. If there is a will, request the appropriate authorised copy.

If there is no will or other applicable succession document, contact a notary to arrange a declaration of intestate heirs (declaración de herederos abintestato). If you believe you are entitled to inherit, provide certificates and documents proving your family relationship; the notary will explain which documents and witnesses are required. The applicable succession law determines who inherits: owning an apartment in Barcelona does not automatically make Catalan succession law applicable. The declaration identifies the heirs but does not, by itself, allocate the apartment.

02 · Formalising the inheritance

Accepting the inheritance and allocating the apartment

Before accepting, review the assets and debts: a mortgage, loans and other liabilities may affect your decision. Acceptance with benefit of inventory (beneficio de inventario) can limit liability for inherited debts, provided its legal requirements are met.

Acceptance records the decision to inherit; allocation establishes what each person receives. Where real estate is involved, these steps are usually formalised in a notarial deed. The tax and Land Registry paperwork must also be arranged. If the inheritance has not yet been registered, ask how registration can be coordinated with the sale: signing a deed and registering it are separate steps.

03 · When you can sell

When can you sell an inherited apartment?

There is no general five-year waiting period. You can prepare the sale once inheritance rights are established and the necessary formalities are under way. The time required depends on the documents, any charges affecting the property and agreement between the heirs.

A five-year period may matter if you claimed the Catalan inheritance tax reduction for the deceased's main home; Barcelona's municipal tax relief has its own holding requirements. Selling early may mean having to repay a tax benefit, so check which reliefs were claimed in your inheritance.

04 · Planning for taxes

Taxes and deadlines: inheriting and selling are separate events

When you inherit Spanish inheritance tax and municipal plusvalía tax.
When you sell Spanish personal income tax (IRPF), or non-resident income tax, on the gain, plus a separate municipal plusvalía assessment.

Under IRPF, tax is not charged on the entire sale price. The gain or loss is calculated using the acquisition value for tax purposes and allowable expenses and adjustments. Each heir declares their share. Inheritance tax depends on the rules applicable to your circumstances, not just the property's location. The general inheritance tax filing deadline is six months from the date of death; an extension must be requested within the first five months. Municipal plusvalía on the inheritance has its own six-month deadline and separate extension procedure. After a sale, the municipal plusvalía filing deadline is generally 30 working days. The six-month period is not a deadline for selling the apartment.

05 · Preparing the property

Which property documents do you need?

Alongside the inheritance documents, prepare the title deed, a Land Registry extract (nota simple), the latest property tax (IBI) receipt and the homeowners' association debt certificate. Check the occupancy certificate (cédula de habitabilidad), energy performance certificate and any required building documentation. A mortgage, tenancy or outstanding special assessment needs to be addressed before completion.

06 · Multiple owners

What if there are several heirs?

A voluntary sale of the whole apartment requires agreement from all owners and the involvement of anyone whose other rights are affected. Agree the asking price, who will coordinate viewings and how offers will be shared.

If one heir wants to keep the apartment or does not wish to sell, you will need to explore the available options and their consequences. Selling your share is different from selling the whole property and may involve different conditions and a different financial outcome.

07 · Particular circumstances

Usufruct rights and selling from another city

A usufruct separates ownership from the right to use and benefit from the property. Both rights must be reviewed to establish what is being sold; the signatures of the bare owners alone do not extinguish the usufruct.

If you live elsewhere, you can organise the paperwork and marketing remotely and consider granting a notarial power of attorney. Living in another city does not necessarily make you a non-resident for Spanish tax purposes. If you are a non-resident, check the specific tax rules and any withholding the buyer may be required to make.

08 · Preparing to sell

Value the apartment and prepare the sale

An up-to-date valuation helps you set a realistic asking price and compare offers. Market value does not always match the value used for inheritance tax. Before deciding, also calculate the costs and the net amount each owner will receive.
